What Minnesotans facing deportation need to know before moratorium expires

ROCHESTER, Minnesota (FOX47) – The Minnesota eviction moratorium ends next week, and there are important things people facing eviction need to know.

Owners have only been able to evict people in recent months for certain offenses such as drug use in a residence, dangerous behavior or using the residence for prostitution.

Starting July 26 in Olmsted County, courts will hear 20 first eviction cases for offenses including property damage and non-payment of rent. Every Monday will now be the day judges hear expulsion cases.

Lawyers for Olmsted County Legal Aid and Southern Minnesota Regional Legal Services have said people must act now if they are threatened with eviction. Organizations have teamed up to offer free services that can help. They advise being proactive when faced with an eviction.

“Make sure you have the ability to connect via Zoom with the court,” said Karen Fairbairn Nath, executive director of legal assistance for Olmsted County. “Either on a computer or using one of our legal kiosks. You can also call. There is a number you can call on your phone. But make sure your phone is charged, your computer is charged. You have to introduce yourself. And the other most important point to remember is that if you are behind on rent, apply for Minnesota Rent Assistance.

By October 13, landlords must give tenants 15 days notice before evicting for non-payment.

After October 13, all eviction procedures revert to pre-pandemic conditions.

Evictions remain permanently in the tenant’s file.

People eligible for assistance but refusing to apply can be expelled as soon as a judge orders it, usually within 24 hours.

Olmsted County Legal Aid and Southern Minnesota Regional Legal Services will be available on Monday to provide legal advice.
